Privacy Policy

Simovate is a trading name of Utelize Communications Limited (Company Number 07462310).

Simovate respects your privacy and is committed to protecting your personal data. This privacy policy will give clarity to you about how we look after your personal data and tell you about your privacy rights. It is important you read this policy together with any other data usage notices we may provide so you are fully aware of how and why we are using your data.

Overview

This policy applies where Simovate is a Data Controller of your information. The terms of this privacy policy do not govern your information where we process that data on behalf of a third-party Data Controller, you should refer to the privacy policy of the relevant Data Controller in that instance. Personal data, or personal information, means any information about an individual from which that person can be identified. It does not include data where the identity has been removed (anonymous data). We shall ensure we have a lawful basis for collection of personal data, namely either:
  • Where we need it to perform a contract into which we are about enter, or have entered, with you.
  • Where we need to comply with a legal or regulatory obligation.
  • Where it is necessary for our legitimate interests, including, but not limited to: keeping our records updated and to study how customers use our products, services or website, to define types of customers for our products and services, to prevent fraud and assess whether to enter into a contract with you.
  • Where you have given consent.
We use different methods to collect data from and about you. This includes personal data you provide when you:
  • Provide us with personal information during our working relationship
  • Apply for our products and services
  • Request marketing to be sent to you
  • Register for a download
  • Apply for a job

Data Retention

We will only retain your personal data for as long as necessary to fulfil the purposes for which it was collected, including for the purposes of satisfying any legal, accounting, or reporting requirements. To determine the appropriate retention period for personal data, we consider the amount, nature, and sensitivity, the potential risk of harm from unauthorised use or disclosure, the purposes for which we process your personal data and whether we can achieve those purposes through other means. We keep information on unsuccessful employment applications for six months in case an alternative role becomes available for which we think you may be suitable. We keep basic personal data and financial information about our customers for the duration of our business relationship with us and thereafter as required for legal and audit purposes. We retain testimonials until withdrawn at your request. In some circumstances we may anonymise your personal data (so that it can no longer be associated with you) for research or statistical purposes in which case we may use this information indefinitely without further notice to you.

Data Security

We have put in place appropriate technical and organisational measures to prevent your personal data from being accidentally lost, used or accessed in an unauthorised way, altered or disclosed. In addition, we limit access to your personal data to those employees, agents, contractors and other third parties who have a business need to know. They will only process your personal data on our instructions and they are subject to a duty of confidentiality. We have put in place procedures to deal with any suspected personal data breach and will notify you and any applicable regulator of a breach where we are legally required to do so.

Sharing your Personal Data

Where you submit personal data to one of our partners and that information needs to be passed through to us to provide a product or service for your use, we will retain that data. We will also collect submitted personal information from our partners where you have expressed an interest in our products/services or company.  We will submit your personal information to our partners where you have expressed an interest in their products/services and you have given your express consent. We will not share your data for any purposes not directly related to the fulfilment of existing contracts, the fulfilment of a legal obligation or by your express request.

Your Rights

You have rights under data protection laws in relation to your personal data. You have the right to request access to your personal data (commonly known as a “data subject access request”). This enables you to receive a copy of the personal data we hold about you and to check it is being lawfully processed. You have the right to request correction of the personal data held about you. This enables you to have any incomplete or inaccurate data we hold about you corrected, though we may need to verify the accuracy of the new data you provide to us. You have the right to request erasure of your personal data. This enables you to ask us to delete or remove personal data where there is no good reason for us to continue processing it. You also have the right to ask us to delete or remove your personal data where you have successfully exercised your right to object to processing (see below), where we may have processed your information unlawfully or where we are required to erase your personal data to comply with local law. Note, however, that we may not always be able to comply with your request of erasure for specific legal reasons which will be notified to you, if applicable, at the time of your request. You have the right to object to the processing of your personal data where we are relying on a legitimate interest (or those of a third party) and there is something about your situation which makes you want to object to processing on this ground as you feel it impacts on your fundamental rights and freedoms. You have the right to request restriction of processing of your personal data. This enables you to ask us to suspend the processing of your personal data in the following scenarios:

  • If you want us to establish the data’s accuracy;
  • Where our use of the data is unlawful but you do not want us to erase it;
  • Where you need us to hold the data even if we no longer require it as you need it to establish, exercise or defend legal claims; or
  • You have objected to our use of your data but we need to verify whether we have overriding legitimate grounds to use it.

If you restrict your consent, we may not be able to provide certain products or services to you. We will advise you if this is the case at the time you withdraw your consent. You have the right to withdraw consent at any time where we are relying on consent to process your personal data. However, this will not affect the lawfulness of any processing carried out before you withdraw your consent. If you withdraw your consent, we may not be able to provide certain products or services to you. We will advise you if this is the case at the time you withdraw your consent. Occasionally it may take us longer than a month if your request is particularly complex or you have made several requests. In this case, we will notify you by email and keep you updated.

The Website

The Simovate website complies to all UK national laws and requirements for user privacy. The site does not record and anonymises individual IP addresses. Simovate does not track the activities of specific visitors to the site and users are expressly asked to ‘opt in’ should they wish to receive further information. The site sets cookies to recognise a computer when a user visits our website. These are used to track users as they navigate the website, improve the website’s usability, prevent fraud, improve the security of the website, personalise the website and validate authenticated user’s sessions. To provide website visitors with more choice on how data is collected by Google Analytics, Google has developed the Google Analytics Opt-out Browser Add-on. The add-on communicates with the Google Analytics JavaScript (ga.js) to stop data being sent to Google Analytics. Communication, engagement and actions taken through external social media platforms that this website and its affiliated accounts participate on are custom to the terms and conditions as well as the privacy policies held with each social media platform respectively. Users are advised to use social media platforms wisely and communicate / engage with due care and caution regarding their own privacy and personal details. Simovate will never ask for personal or sensitive information through social media platforms and encourage users wishing to discuss sensitive details to contact them through primary communication channels such as telephone or email. We may use social sharing buttons which help share web content directly from web pages to the social media platform in question. Users are advised before using such social sharing buttons that they do so at their own discretion and note that the social media platform may track and save your request to share a web page respectively through your social media platform account. Our social media platform accounts may share web links to relevant web pages. By default, some social media platforms shorten lengthy URLs (e.g. http://bit.ly/zyVUBo).

Marketing

We may receive personal data about you from third party organisations or public sources for the purpose of providing you with information about our products and services we believe to be relevant. On the first occasion of receiving marketing information from us you will get a clear and express opt-in consent option. If, and only if, you choose to opt-in will we store your personal data and continue to send you further information. If you do not opt in after a period of one month your data will be anonymised. We retain anonymised data for market research purposes.

As statutory and online requirements change so this policy document may change. Any changes will be highlighted to ensure that you can respond.

Complaints

You have the right to make a complaint at any time to the Information Commissioner’s Office (ICO), the UK supervisory authority for data protection issues (www.ico.org.uk). We would, however, appreciate the chance to deal with your concerns before you approach the ICO.
